Quality Gains delivers services in Personal Training/ Online Coaching (Functional Training, Weight management, medical fitness, motivation coaching) and Health Management (nutrition plan, nutrition counselling). 2. Health Questionnaire of the client
Quality Gains creates for every client, according to the provided (Questionnaire) data of the client, an individual workout and nutrition plan. The client is obliged to fill out the questionnaire truthfully and according to his present health situation. Various diseases (chronical pain, allergies, operations, medical treatment, inherited diseases etc.) and feelings of discomfort need to be clearly communicated to Quality Gains in the beginning.
The client is obliged to inform Quality Gains, if his health situation has changed in any way (e.g. accident, operations, allergies etc.).
3. Data privacy
Every personal data is subject to data privacy and are treated confidentially. The trainers of Quality Gains are bound by the rules of professional secrecy (DE: ‘Datenschutzgesetz’).
4. Price and payment methods
The charge for the appointment, the membership or the mentoring service needs ot be paid in advance. In case of a yearly membership, one month in advance, on the first day of the month. In the case personal trainings the amount can also be payed in cash.
5. Liability and insurance
The client is aware that there is a health risk involved in physical training. The termination of an insurance contract is the responsibility of the client. We recommend, in any case, the completion of an adequate insurance contract. A liability of Quality Gains is excluded.
6. Registration and membership
A registration for a personal training or a different type of service can be made both orally (only the first consultation) and in writing. The membership (personal training hours, online coaching, health questionnaire) is legally valid with the signature of the client or an online inscription on the website.
7. Cancellation policy
The client, in case of disease, holidays etc., has to cancel at least 24 hours before any appointment with Quality Gains (personal training session, Skype consultation, nutrition consulting) in written form (e-mail and letter). If the client misses the cancellation deadline, there is no right for compensation of the service. If the service of Quality Gains is not used by the client, there is no right to a reduced offering or a monetary compensation. Quality Gains retains the right to cancel or relocate appointments short term.
8. Resignation in case of disease or accident
If a membership can not be used in the case of disease or accident, there is the possibility to immediately submit a valid medical certificate, to postpone the service or transfer it to another person. In other cases any compensation or transfer from Quality Gains is impossible.
9. Place of jurisdiction and applicable law
The place of jurisdiction is Zurich, respectively the legal provisions. The contract with Quality Gains is subject to the Swiss law.
